Tribal Consultation

Overview | Identifying Tribes for Consultation | Good Faith & Reasonable Effort | Understanding Tribal Sensitivities | Additional Guidance | Best Practices | State DOT Programs

Overview

Tribal consultation is now an integral part of compliance with Section 106 of the National Historic Preservation Act, in addition to other laws, regulations and Executive Orders. Information related to policies, protocols, guidance and best practices on tribal consultation, however, is scattered among many different sources and is often not readily available. This website provides transportation professionals with a one stop source for information on tribal consultation. The website contains documents and links to documents and websites that address all key aspects of tribal consultation, including:

Information and guidance on these topics are from many sources, including:

  • Federal, tribal, and state policies and protocols
  • Federal, state and tribal guidance documents,
  • Case law
  • Tribal databases
  • Best practices as implemented by federal and state agencies and tribes

Information contained in this website will be periodically updated as new policies, protocols, guidance and best practices are developed.  Center for Environmental Excellence by AASHTO encourages users of this website to send in any additional or new information that would benefit transportation professionals, tribes and other parties involved in the consultation process.  Please email your information to Shannon H. Eggleston, Director, Center for Environmental Excellence by AASHTO, at seggleston@aashto.org.

Note: Information is often repeated under more than one topic included in this website, as the information is relevant to more than one topic.  In this way, a user can look up a single issue and have access to all relevant information and best management practices associated with that issue.
