Agreement Overview:

This Programmatic Agreement between the Pennsylvania Department of Transportation (PennDOT) and the Federal Highway Administration (FHWA) establishes terms for delegation of review and approval authority for specific types of transportation projects eligible for Categorical Exclusions (CEs). This new agreement replaces the Categorical Exclusion Programmatic Agreement of May 1995 and institutes the recommendations of the Exemption Agreement and Engineering Management Systems Task Forces to reduce the number of levels of Categorical Exclusion Evaluations (CEEs). It expedites and standardizes reviews of Categorical Exclusions (CEs). The PA is supported by an online (paperless) Expert System, which is an electronic forum to complete and approve CEs and Environmental Assessments (EAs). The Expert System provides standards for completing NEPA documents, validation and guidance for business rules, check-in/out capabilities for workgroups, a checklist for progress and status tracking, an interactive review and approval process, and online reference and help information. The online system, which can be viewed at https://www.dot2.state.pa.us/ceea/ceeamain.nsf/?open, allows FHWA to see every project from their desktop as soon as the entry is created.

Renewal Provisions/Process:

The PA is audited every five years by FHWA. The July 2005 Pennsylvania DOT CE Handbook updates and gives rules and mandates to implement the system.

Comments on Development/Use of PA :

The success of this PA rests on the relationship developed and maintained between the PennDOT and the FHWA Division office.

The online Expert System provides links to automated GIS layers for both cultural resources and threatened and endangered species.
