Case Law Updates on the Environment (CLUE)

The Center for Environmental Excellence provides several resources to assist policymakers, practitioners, and others in informing their next project with the current laws and agreements that exist.

CLUE is a storehouse for tracking and sharing case law updates on the environment. The Center for Environmental Excellence by AASHTO maintains CLUE and keeps all content relevant. The database primarily includes recent court decisions involving challenges to environmental reviews and permits for highway and transit projects. The Center will continue to expand the database over time to include additional court decisions, so please check back often.

We conduct a review every year of the CLUE database to spotlight a sampling of federal court decisions issued for surface transportation projects. The goal of this report is to provide NEPA practitioners, both lawyers and non-lawyers, with a general understanding of how courts have handled the types of issues that frequently arise in NEPA litigation.
